SUGARCREEK (Tusco TV) - Police still aren’t releasing the name of the man shot and killed Wednesday morning outside of a downtown business after assaulting a Sugarcreek Police captain, but they are offering more details about how the incident unfolded.

Sugarcreek Police Chief Kevin Kaser says Captain Brian Dalton was investigating a complaint about a commercial vehicle driving through a no-truck area and causing some property damage. He says when Dalton made contact with the driver at the TMK Farm Supply store where the situation escalated, and the man stabbed him. Kaser says that’s when Dalton drew his weapon and opened fire.  

"He was investigating a complaint and the suspect decided he wasn’t ok with it, and the situation just turned bad. He assaulted the officer with a weapon, which caused the officer to go to the means of using his weapon, which is deadly force, and the officer was injured in the process and the suspect is deceased," he says. 

Kaser says they have in-car and body cam footage of the incident, along with surveillance video from the business. He says after reviewing some of the footage, it appears Dalton’s use of deadly force was justified in the incident, but he says the Ohio Bureau of Criminal Investigation is handling the investigation and will make the final call. 

"There’s plenty of video coverage to cover the incident to be able to tell you exactly what went on. I mean, there’s no doubt in watching it what took place," he says.

Kaser says once BCI gives him permission, he’ll release those videos so the people can see for themselves exactly what happened. 

"[That’s] why we bought them, for our protection and everybody else’s and to give the answers that people may seek in a situation like this. Like I said, there’s nothing unturned. I mean everything is there, and I mean, it’s firsthand, so when the time comes and people have those questions and want those answers, they’re gonna get ‘em," he says.

Kaser says the driver involved in the incident was a man in his early-30s from North Carolina who was in the area making deliveries. He says they still have a few more family members to notify before they’ll be able to release his name. 

Dalton was life-flighted to an area hospital where he remains in stable condition. He has been with the Sugarcreek Police Department for eight years and was promoted a year ago from sergeant to captain.
